College rapist ‘forced himself on student’ while she was vomiting in toilet

An 18-year-old has been arrested after he allegedly raped a fellow student while she was throwing up in a dormitory toilet.

Indiana University student Samuel Elliott was detained by cops and charged with rape after he was accused of committing the sex offence while the victim was drinking with friends on campus.

A probable cause affidavit seen by local newspaper The Herald Times says that the alleged victim was initially reluctant to press charges against Elliot after the incident two months earlier, but had been persuaded to go to police by her fellow students.

One of her friends had even reportedly kept a used condom from the night in the fridge as evidence, which he later handed over to investigators.

The document states that the victim had been drinking as a group of seven at the Tater-Thompson residence hall last year when they had to move to a nearby dorm room after being asked to leave.

Television station Fox WXIN reports that she told investigators that she decided to lie on the floor after becoming "extremely drunk" and unwell when Elliot “tried to touch her inappropriately".

She then moved into the shared bathroom and began vomiting in a toilet. Elliot then allegedly entered and asked if he could have sex with her, and she replied by saying she was too drunk to make a decision.

After she began vomiting in the toilet again, the victim alleges that Elliot began to lower her pants, before he began raping her.

The assault reportedly only ended when a victim's friend called her on FaceTime, after which Elliot is said to have asked her not tell any of her friends about the incident.

After the incident was reported on December 6, cops issued a warrant for Elliott's arrest on January 20, which saw him arrested a week later.
