Autistic girl ‘restrained’ for throwing poo at school when she couldn’t use loo

An autistic girl who threw her own poo around a classroom was allegedly left with a blistering bruise the 'size of a hockey puck' when restrained.

"Enraged" mum Dawn Malvase has filed a lawsuit against the Poudre School District following the incident which escalated when her daughter, Jalilah Al-Haddad was stopped from using the loo.

According to Ms Malvase's law suit, her mostly non-verbal 14-year-old daughter was told on a school day in March 2020, that she had to wait to go to the bathroom.

She adds that the alleged action then taken by school staff to restrain Jalilah, was unlawful.

Ms Malvase told local Colorado news outlet KDVR : “You can't deny someone from using the bathroom.

“I was enraged. I was in shock. I didn't know what to do. You're caught in a place where you trust these people with your child and something like this happens.”

Ms Malvase decided to file the suit after an investigation by Fort Collins Police found no wrongdoing on the part of the school district, The Sun reports.

According to the lawsuit, Jalilah was left in distress after being told she could not leave the classroom for the loo and so soiled herself and started to throw faeces around the room.

Court documents say the 14-year-old was then dragged to a room and restrained which Ms Malvase alleges, injured her daughter.

The mother had her daughter examined by a physician, who notified Child Protective Services.

Describing the alleged wound, Ms Malvase said: “It clearly looked like a rug burn … It actually looked like a wound the size of a hockey puck that was blistering."

After Fort Collins Police saw nothing illegal in the incident, Ms Malvase took matters into her own hands.

Her lawyer, Igor Raykin said: “State law says they are not allowed to restrain that child unless the child is posing a substantial risk to herself or others.”

According to reports from KDVR, Malvase and Raykin also allege the school never documented the use of restraint in the incident, which is required by Colorado law.

The district said in a statement: “'Poudre School District takes the safety and wellbeing of all our students and staff seriously. The district does not comment on confidential student matters.”

“PSD determined that staff followed appropriate district policies and procedures. Generally, we can confirm that Fort Collins Police Services investigated this situation in 2020 and found no wrongdoing on behalf of the school district.”

Ms Malvase said: “'It's like traumatizing a 2-year-old. You can't speak about what happened and how it affected them.”
